These terms supplement the Terms of Service, Acceptable Use Policy, Privacy Policy, and, for customer-controlled recipient data, the DPA. They apply when Smailor makes its Telecom/SMS service available to your account. If there is a conflict about Telecom/SMS, these terms control, subject to mandatory law. Publication of these terms does not mean Telecom plans are currently on sale or that SMS sending is enabled.
1. A separate service and subscription
Telecom plans are separate from email plans. An email plan may suggest a Telecom plan, but it does not buy, activate, or require one. A Telecom plan may be bought on its own if the service and the plan are offered to your account. An email subscription does not grant an SMS allowance, and cancellation of one subscription does not automatically cancel the other.
Each offered Telecom plan states its monthly price, included SMS segments, available features, billing period, and any geographic limits before purchase. A segment is a billable part of an SMS, not necessarily one message: character set, message length, sender information, and an opt-out instruction can increase the segment count. An estimate is shown before submission where the product supports it. The provider may accept a message that is later undelivered; a delivery receipt is not a guarantee of receipt by a person.
Included segments are usable only during the relevant subscription period and do not carry over. Sending above the allowance is blocked unless a separately priced route and balance are available and you choose to use them. International sending is disabled unless expressly enabled for your account; its destination and price must be available before you send. No access to a destination, route, sender name, campaign tool, or API is implied by buying a plan.
Telecom renewal, cancellation, taxes, refunds, and mandatory consumer rights follow Section 3 of the Terms of Service and the checkout terms shown for that purchase. If we cannot lawfully provide a paid Telecom service, we will apply the remedy required by law. A compliance suspension does not by itself erase a valid billing or refund claim.
2. Eligibility and verification
We may require account identity or business verification before Telecom activation or sending. Verification is a reusable account control and may also be required for other sensitive services. We request only documents needed for the stated review, restrict review access, and process them as described in the Privacy Policy. Approval is not a licence to send to any recipient, and we may recheck or revoke approval when information is inaccurate, expired, or associated with abuse. You must keep submitted information current and must not upload another person's identity document without authority.
3. Your responsibility for recipients and messages
You determine the recipients, purpose, content, and timing of your messages and are the controller of recipient data. We process that data on your documented instructions under the DPA, except where we must act for our own security, billing, legal obligations, or abuse prevention. You must comply with the rules of the recipient's country as well as the Telecom rules in our Acceptable Use Policy.
For marketing SMS, our platform policy requires provable prior, specific permission for SMS marketing from every recipient, including business contacts. This is stricter than some local exceptions. Acceptance of general terms, an unselected checkbox, a purchased list, or silence is not proof. You must retain a record of the notice, consent wording, time, source, recipient, sender, and any withdrawal, and provide evidence when reasonably requested. Transactional or service messages must relate to the service requested by the recipient; a promotional message cannot be made transactional by changing its label.
Marketing sending is currently paused while recipient consent evidence and opt-out routing are being completed. A Telecom plan's future campaign feature does not override this pause.
Every marketing message must identify the organization behind it and provide a simple, effective, no-extra-cost way to object. You must honor a STOP reply, other objections, and suppression records before future sends, including after importing or replacing a list. A platform-added opt-out line does not replace your legal responsibility, and sending must remain disabled for a route if its opt-out mechanism has not been validated. Do not use Telecom for emergency alerts or as the sole channel for time-critical safety messages.
4. Sender names, routing, and delivery
A requested sender name remains unavailable until we and the relevant provider approve it. You must be entitled to use it and must not impersonate a brand or public body. A carrier may replace or reject a sender name. Routing may involve our SMS provider and electronic communications carriers; destination networks may be outside the EEA for international sends. We may delay, reject, or stop a message or campaign for legal, provider, fraud, capacity, or recipient-protection reasons. We do not guarantee immediate dispatch, carrier acceptance, delivery, or a response channel.
Where replies are offered, they may be unavailable for a sender name or route. Do not tell recipients they can reply to a non-replyable sender. You are responsible for providing a working alternative objection channel when needed.
5. Suspension and contact
We may pause Telecom selling or sending globally or for an account, including while verification, provider configuration, sender approval, opt-out handling, or abuse concerns are unresolved. We may ask for consent evidence and cooperate with carriers and competent authorities as required by law. Report unwanted SMS or sender impersonation to [email protected]; privacy requests go to [email protected].
